On the morning of July 7th, 2009, Dow Chemical responded to a report of a chemical leak at its Hahnville, Louisiana, plant and moved quickly to contain the damage. The incident: the airborne release of ethyl acrylate. What is ethyl acrylate? According to NOLA.com, it's a chemical "used in the manufacture of a wide variety of household and cleaning products." If you have ever been cleaning and suddenly been taken aback by the strong smell of the product you are using, you can only imagine the reaction residents of Hahnville, Southeastern Louisiana and the Metro New Orleans area had when, with the storm and winds, ethyl acrylate "came to town."

The reaction was quick and, unfortunately, severe. Hundreds to thousands of Louisiana residents and tourists began to suffer nausea, headaches, dizziness, burning of the eyes and a myriad of other reactions all because of this chemical leak. Tourists were left, no doubt, wondering just how many problems New Orleans faces when waking up to enjoy the sites and sounds of the South and were instead knocked back with this formidable smell. And for a region who has suffered some of the worst Mother Nature can offer, a man-made and preventable calamity such as this is just too much.

Concern has developed in the last couple years as reports continue to build of various companies and sites around the nation experience chemical spills, trucks leak hazardous fluid en route to destinations, etc. Doing a simple Google search of "chemical spill plant" shows a timeline of news events that have covered these catastrophes and, as technology and safety backups continue to be upgraded and instituted, there does not appear to be any slowing of a trend of incidences or accidents.

Because of this incident and with the firm belief it could have been prevented through due diligence and secure measures by Dow Chemical, the Berniard Law Firm has been contacted and chosen to represent a great number of clients who are looking for a remedy to this horrible experience. Even now, the full extent in which the various cities and communities that have been affected cannot be completely assessed but lead attorney Jeffrey Berniard, his firm and co-counsel are intent on making sure the rights of the people of Louisiana to live in a state free of chemical leaks and dangerous business practices are upheld. We are now taking clients to enter into the class action as well as looking into case-by-case individual claims.
